Death Lawsuit Filed Regarding Death Of Illinois State Police Trooper

In the November 27 blog post (“State Trooper Killed On I-55 Near Litchfield, Illinois“) the November 26, 2012 accident which led to the the death of Illinois State Trooper Kyle Deatherage, 32, was summarized.

A wrongful death suit was filed Wednesday (January 9) in connection with the accident, by the widow of Kyle Deatherage, Sarah.

The wrongful death and misconduct suit, filed in Madison County, names driver Johnny B. Felton, DOT Foods and subsidiary DOT Transportation.  The suit claims, in part, that the driver should have never been allowed to drive the truck, given a medical condition that made him “medically unfit” to drive and therefore was an ““imminent danger to the public.”

In November, the U.S. Department of Transportation said that Felton Jr., 51, of Hinesville, Ga., lost consciousness before the crash. The agency issued an order declaring Felton an “imminent hazard,” barred him from commercial driving and said that he had an unspecified medical condition that should have made him ineligible for a commercial license.
