Elman Law Group, LLC Wins Big With A Stunning $621,000 Jury Verdict In Cook County (Chicago, Illinois) “Wrist Fracture” Car Accident Case

Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Franklin County Crash Injures One Driver

There was a Southern Illinois car accident Thursday morning (February 4, 2016) in Franklin County.

The two-car accident happened as a driver,  Brendan A. Wollard, 30, of Carterville, Ill., was exiting Interstate 57 north to Illinois Route 14. His car approached the intersection with Illinois Route 14 at the top of the ramp, which is controlled by a stop light.

As stated in the kfvs12.com article of February 4, 2016, titled “Woman injured in two-car crash in Franklin Co., IL“:

Wollard failed to stop at the red light and entered the intersection.

Wollard’s car struck a car driven by Jennifer N. Sullivan, 38, of Thompsonville, who was traveling eastbound on Illinois Route 14 at the time of the crash.

Sullivan was taken to a hospital for treatment of her accident injuries.  Wollard was not hurt during the crash.

Wollard was cited for operating an uninsured motor vehicle and disobeying a traffic control device.

Snow And Ice Cause Adverse Driving Conditions In Southern Illinois

There have been hazardous road conditions in various Southern Illinois areas recently, leading to a variety of vehicle accidents.  Snow and ice – including “black ice” – have been named as factors in a number of crashes.

National Weather service officials are predicting two to four inches of snowfall for the area, visibility to be ½ mile or less and any snow that falls will immediately stick to roadway surfaces.

The January 18, 2016 The Randolph County Herald Tribune article titled “Black ice causes havoc” discusses various recent accidents in which the cause of the accident is suspected to have been “black ice.”

For those unaware of “black ice,” it is a very slippery condition that is especially dangerous as it can be very hard to see.  As such, if a vehicle runs over “black ice” it often leads to loss of control and, in many cases, vehicle accidents.

Fatal Truck Accident On Illinois 148

There was a fatal truck accident Thursday (January 7, 2016) on Route 148 in Williamson County.

According to the Illinois State Police (ISP) the accident happened at approximately 9:20 a.m., on Route 148 just north of Ogden Road.

At that time, a southbound semi hauling coal – for reasons currently unknown – crossed into the northbound lane.  In doing so, it came into the path of at least two northbound vehicles, a Dodge Ram and Dodge Durango.

An excerpt from the wsiltv.com article of January 7, 2016 titled “Route 148 reopens following fatal crash“:

The driver of the Durango was able to swerve onto the shoulder, avoiding the semi. The semi sideswiped the Dodge Ram, continued across both lanes, rolled over and came to rest upright in the ditch on the west side of 148. The load of coal spilled during the rollover.

The driver of the semi, identified as Randall W. Engleby, 62, of Harrisburg, was declared dead at the accident scene by the Williamson County Coroner.

The driver of the Durango hit her head while swerving to avoid the oncoming semi.  She was taken to a hospital for treatment of her accident injuries.

The driver of the Dodge Ram and two passengers were also hurt and taken to hospitals for treatment of their crash injuries.

Route 148 was closed to traffic for 6 1/2 hours.

Increased Holiday Traffic Safety Initiatives

On December 21, 2015 the Illinois Department of Transportation issued a press release titled “IDOT, Law Enforcement:  Drunk Driving Ruins the Holidays.” (pdf)  The press release discusses various statistics and other aspects concerning drunk driving fatalities in Illinois, and also mentions the number of fatalities over the extended Christmas weekend in 2014.  Extended enforcement initiatives, including roadside safety checks and seatbelt monitoring efforts, are also discussed.

A couple of excerpts from the press release:

In 2011, NHTSA estimates there were 278 drunk driving fatalities (motor vehicle deaths involving at least one driver with a BAC of.08 or higher) in Illinois. But in 2012 and 2013, the number increased to 322, a 15 percent increase from 2011. There was a slight decrease in 2014, with 317 drunk driving fatalities in Illinois in 2014, according to NHTSA estimates. As recently as 2007, there were 439 drunk driving fatalities in Illinois.

For 2013, Illinois had 322 drunk driving fatalities, which was 32.5 percent of total traffic deaths in the state and was the same amount from 2012.

I-57 Semi Truck Crash In Jefferson County

As discussed on the “Truck Accidents” page, there are many potential causes of truck accidents that happen throughout Southern Illinois as well as the broader Illinois region.

While there are many reasons for truck accidents, driver fatigue has been featured prominently as there have been many recent serious accidents that have been attributed in full or in part to driver fatigue.

A December 16, 2015 truck accident in Jefferson County caused the truck driver to suffer what the Illinois State Police (ISP) described as “incapacitating injuries.”

While the cause of this truck accident has yet to be publicly stated, the accident involved a truck failing to negotiate a curve on Interstate 57 (at milepost 92) at approximately 11:45 a.m.

The truck, driven by James Patton, 57, of Watertown, Pennsylvania, then left the roadway and drove through the expressway guardrail.

Then, as described in the December 16, 2015 WPSD Local article titled “Driver injured in single-vehicle semi wreck in Jefferson County“:

Troopers say the semi traveled down the embankment and through another guardrail before coming to rest in the eastbound lanes of I-64.  Patton was taken to a hospital with what ISP describes as “incapacitating” injuries.

According to sources, first responders who went to the accident scene included the Jefferson Fire Protection District and Mt. Vernon Fire Department, as well as the Jefferson County Sheriff’s Department, and the Illinois State Police (ISP).
