Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Police says the preliminary investigation shows Clarkson was driving his cycle northbound on North Broadway (U.S. 51) when a pickup driven by 58-year-old Thomas Joy of Woods Lane in Centralia pulled from an alleyway near the Broadway Tavern in front of him. Clarkson then crashed into the pickup truck.

Clarkson, 65, of Odin, died in the process of being flown to a hospital.

Joy was not injured during the accident.   Following the accident, Joy was ticketed for driving under the influence (DUI).

Motorcycle Accident In Jerseyville Involving Collision With Pedestrian

There was a Thursday (May 10, 2018) night motorcycle accident in Jerseyville in which a motorcycle collided with a pedestrian.  The accident happened on U.S. 67 just south of Hillside Road.

Randal Giberson, 60, was riding a 2007 Yamaha motorcycle north on U.S. 67 around 8:31 p.m. when Anna Townsend attempted to walk across the highway at Hillside Lane, according to a release from Illinois State Police Trooper Heath Bryan.

The motorcycle struck the woman and both people on the motorcycle were ejected, police said.

During the crash the motorcycle’s passenger, identified as Ann Norris, 58, of Jerseyville, as well as Anna Townsend (also from Jerseyville) were both critically injured.  They were flown to Barnes-Jewish Hospital in St. Louis for treatment of their accident injuries.

The accident investigation is being conducted by the Illinois State Police Traffic Crash Reconstruction Unit.

Fatal Illinois 157 Motorcycle Crash In Madison County

There was a fatal Illinois 157 motorcycle crash Wednesday (May 9, 2018) morning in Madison County.  The motorcyclist died at the accident scene.

According to information provided by the Illinois State Police, the motorcyclist was riding southbound on Illinois 157 when the motorcycle failed to negotiate a curve in the roadway.  The motorcycle crashed into a ditch, and the motorcyclist was ejected during the crash.  Illinois State Police first responded to the accident at 6:10 a.m.

The motorcyclist was identified as Joshua Renfrow, 26.

Motorcyclist Suffers A Serious Head Injury During Southern Illinois Crash

There was a Southern Illinois motorcycle loss of control accident Thursday (April 26, 2018) afternoon in which the motorcyclist was ejected and seriously injured.  The motorcyclist suffered what was described as a serious head injury as a result of the crash.

The Wood River Police Department was called to the accident scene at 4:21 p.m.  The accident scene was on Illinois Route 255 near Illinois 111.

An excerpt regarding the crash, from the Alton Telegraph article of April 26, 2018 titled “Man sustains serious head injury after being thrown from motorcycle“:

The man was traveling north on Illinois 255. As the male came to a bridge crossing over Illinois 111, the male lost control of the motorcycle and crashed. The male was thrown from the motorcycle to the side of the roadway. A witness to the crash remained at the scene until officers arrived, police said.

The motorcyclist was flown to a hospital in the St. Louis area for treatment of his accident injuries.

The cause for the loss of control either does not appear to be determined or publicly disclosed at this time.

This Southern Illinois motorcycle accident remains under investigation.

Truck-Motorcycle Collision On I-159 Near Holiday Shores

As discussed on the “Early-Season Motorcycle Riding Safety Issues” page, there are many reasons why riding a motorcycle in the early Illinois motorcycle season (generally starting in March or April) can be more hazardous than riding during the summer and fall.

One of these reasons is that motorists are not as used to “seeing” motorcycles in March and April as they are later in the season.  As discussed often on this site, one of the main reasons that motorcycle accidents occur is that motorists “fail to see” motorcycles and therefore fail to avoid collisions with them.
