Elman Law Group, LLC Wins Big With A Stunning $621,000 Jury Verdict In Cook County (Chicago, Illinois) “Wrist Fracture” Car Accident Case

Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Fatal Three-Vehicle Crash In Clinton County

There was a fatal vehicle crash Saturday afternoon (January 14, 2017) on new U.S. 50 in Clinton County.  The multi-vehicle crash happened between Trenton and Aviston.

Details on the accident appear limited at this time.  The cause of the accident does not appear to be publicly disclosed as of this writing, and the accident remains under investigation.

The accident involved three vehicles, with at least one of the vehicles leaving the highway and overturning.

Ice on the roadway, which has been a significant concern – and cause of various crashes in Southern Illinois lately – seems to have been at least a contributing factor to the accident.  An excerpt from the Belleville News-Democrat article (with crash scene photos) of January 15, 2017, titled “Second person dies after fatal accident in Clinton County, IL“:

…there were reports that a thin layer of ice had formed on the roadway

The crash seems to have happened at approximately 3:15 p.m.

Two people died in the crash, and one person appears to have been injured.

The two people that died, according to the Clinton County Coroner, were Marissa Flanagan, 19, of Vernon and Randy L. Pulver, 62, of Beckemeyer.  They were in separate vehicles at the time of the crash.

A crash investigation is ongoing.

The Recent Increase Of Illinois Fatal Traffic Accidents

On December 17, 2016 the State Journal-Register published an article titled “Speeding ticket numbers down, fatalities up on Illinois roads.”  The article discusses trends in Illinois traffic fatalities, the number of speeding tickets being issued by the Illinois State Police (ISP), and what factors may be causing the increase in Illinois fatal traffic accidents.

Meanwhile, the number of traffic fatalities statewide has bounced around a bit, but overall, the number of people killed on Illinois’ roads is higher than it was five years ago. In fact, for the first time since 2008, Illinois in 2016 has surpassed the 1,000 mark in annual statewide fatalities.

Fatal Washington County “Head-On” Collision Caused By Ice

There have been many Southern Illinois accidents that have been caused by ice on the roadway.  The types of accidents which have been caused by such “icy” conditions include collisions, “spinouts,” rollovers, and other types of loss of vehicle control accidents.

One type of ice on the roadway that has been particularly hazardous is “black ice.” On this site, “black ice” has been discussed in various individual accidents, and the overall topic is further discussed on the “Southern Illinois Car Crashes Caused By Black Ice” page.

A Southern Illinois fatal “head-on collision” is being attributed to ice on the roadway.  The accident happened in Washington County on Friday, December 16, 2016.

According to the Illinois State Police (ISP), the collision happened at approximately 6:00 p.m. on Route 153, just to the south of County Highway 10.

The accident happened as a driver of a 2003 GMC van, heading north on Route 153, lost control of the van after hitting an ice patch on the road.  The van then went into the opposing lane, and in doing so had a “head-on collision” with a pickup truck.

A 23-year-old male passenger in the van was declared dead at the accident scene.

The driver of the van, identified as Becka Heitman, 45, of Addieville, was seriously injured and taken to a hospital for treatment of these injuries.

The driver of the pickup truck was identified as Klif Kline, 60, of Coulterville.  He was also seriously injured and taken to a hospital for treatment of these injuries.

This wreck was one of many crashes that occurred in Southern Illinois during this storm, which has been named “Decima.”  An excerpt from the The Randolph County Herald Tribune article of December 17, 2016 titled “Winter Storm Decima impacts area“:

According to the Facebook page for the Illinois State Police’s District 11 office in Collinsville, at least 130 accidents were pending attention from a District 11 trooper at the height of the storm.

Winter Storm Decima brought freezing drizzle to Southern Illinois, creating a light glazing of ice that made parking lots, sidewalks, roads and other untreated surfaces hazardous.

“Black Ice” As A Southern Illinois Accident Cause

What makes “black ice” particularly dangerous is that it is often difficult – if not impossible – to see.  Often, it will occur on dark pavement, which makes it difficult to discern.  At night, it is particularly problematical.

Accidents that have occurred due to such icy conditions have caused a variety of accident types, including collisions, “spinouts” and rollover accidents.  Often such accidents occur at significant speeds, which exacerbates the impacts and accident injuries that occur.
