Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Motorcycle Crash In De Soto

There was a motorcycle accident Wednesday night (May 20, 2015) in De Soto, Illinois.  This accident involved a motorcycle colliding with a pickup truck.

The crash happened at approximately 11:40 p.m. on Highway 51, south of De Soto.

According to the sheriff’s office a Dodge pickup driven by Kenneth Gulley, 38, of Carbondale was northbound trying to make a left turn into a business area. Some vehicles were behind the truck while Gulley waited for traffic to clear before turning.

A motorcycle driven by Jacob A. Voigts, 27, of Carbondale, then tried to pass the line of cars. Voigts’ motorcycle hit the driver’s side of the truck and the man was thrown off.

Voigts suffered injuries that were considered to be “life-threatening” in nature.  He was first taken to a local hospital for treatment of his accident injuries, and then taken to a St. Louis hospital.

Fatal Pickup Truck Accident In Mascoutah, Illinois

There was a fatal pickup truck accident Friday (May 8, 2015) on Illinois Route 161 in Mascoutah, Illinois.

The Mascoutah Fire Department responded to the crash just before 1:00 p.m.  The accident scene was about at a fourth of a mile west of North Sixth Street.

The accident involved the westbound pickup truck sliding off the road, sending it off the shoulder and into a ditch.

Police said there was a short but heavy rain at the time of the accident. A witness who was traveling eastbound said the truck may have hydroplaned causing the driver to lose control and slide off the side of the roadway.

According to the St. Clair County Coroner Dennis Nichols, the driver of the pickup truck was identified as Anthony Biondo, 71, of New Baden.  He died at the accident scene.  The passenger was pronounced dead after being taken to St. Elizabeth’s Hospital in Belleville.  She was identified as Roseanne Dennis, 53, of New Baden.

Motorcycle Accident On Route 154 In Perry County

There was a Southern Illinois motorcycle accident Friday morning on Route 154 in Perry County.

Details on the accident, its causes, and accident injuries appear limited at this time.

According to Illinois State Police (ISP) the accident happened in a construction zone on Route 154 at Hitt Road at approximately 10:40 a.m.

The ISP says that the accident was a “chain-reaction” crash, in which a truck driven by Gary Lahmann of Farmington, Missouri “rear-ended” a motorcycle, which in turn hit a truck ahead of it.

The motorcyclist, identified as Timothy Wisneski of Nashville, fell to the ground during the course of the accident.

All three drivers were taken to Marshal Browning Hospital in DuQuion for treatment of accident injuries.

Fatal I-57 Motorcycle Accident In Williamson County

There was a Southern Illinois fatal motorcycle accident Tuesday evening (April 14, 2015) on Interstate 57 (I-57) in Williamson County.

According to the Illinois State Police (ISP), the accident happened at approximately 9:45 p.m., on I-57 northbound.

At Herrin Road, a motorcycle attempted to merge onto I-57.

Then, according to the April 15 wpsdlocal6.com article titled “Motorcycle rider killed after hitting two semis on I-57“:

A motorcycle was merging onto I-57 from Herrin Road and failed to yield the right of way to the semi in the right lane. The driver of the semi hit his brakes to avoid hitting the motorcycle.

The motorcycle continued into the left lane, where it hit the semi in that lane.

During the course of the accident, the motorcyclist was ejected from the motorcycle.

The motorcyclist was identified as James Randolph, 41, of Christopher.  He was killed during the crash.

Neither of the semi truck drivers were injured during the crash.

According to the ISP, Randolph did not yield the right of way when he was attempting to enter the interstate.

The accident remains under investigation.

Fatal Car Collision On Illinois Route 37 In Marion

There was a fatal “head-on collision” Wednesday (April 8, 2015) in Marion, Illinois.

According to the Illinois State Police (ISP), the accident happened at approximately 5:50 p.m. on Illinois Route 37.  At that time, a man driving a pickup truck southbound near Reservoir Road crossed into the northbound lane and struck a 2002 Jeep Wrangler traveling northbound.

The driver of the pickup truck, who has only been identified as a 72-year-old man from Goreville, was taken to Heartland Regional Medical Center for treatment of his accident injuries.  He later died.

The driver of the Jeep Wrangler, identified as Trey Holmes, 23, of Marion, was taken to a hospital with injuries considered to be non-life-threatening in nature.

Both vehicles sustained major damage and Illinois 37 was closed for about three hours during the investigation and re-opened around 9 p.m. State Police listed alcohol/impaired driving as the cause of the crash.
